Kraken this week launched CFTC-regulated perpetual futures for eligible U.S. clients, a product type that's historically been the domain of offshore exchanges. By linking perpetuals to regulated derivatives infrastructure rather than an offshore-only venue, the exchange could pull some crypto derivatives activity back into a supervised framework.
Not for everyone
Eligibility is restricted — the product isn't open to all U.S. retail traders. Kraken is limiting access to clients who meet certain criteria, a move that keeps the launch within the bounds of U.S. derivatives regulation while still offering leveraged long or short exposure without an expiry date. Funding payments keep contract prices close to the spot market, a feature that's common on offshore platforms but new to a CFTC-supervised setting here.
A domestic regulated product may make it easier for institutional firms to participate without relying on offshore structures. That's a big deal for a market where many big players have had to use non-U.S. venues to get perpetual exposure. For Kraken, spot trading alone is no longer enough — the launch strengthens its position in the derivatives market at a time when exchanges are competing for sophisticated order flow.
Risk remains
Perpetual futures are leveraged products and carry real risk. Regulation doesn't eliminate the possibility of liquidation or funding rate costs. Traders should know that the CFTC stamp doesn't make these contracts safe — it just means they're operating inside a legal framework with oversight.
What this signals
The move suggests the U.S. crypto market is becoming more sophisticated, following the spot ETF approvals. Regulated derivatives give traders more ways to hedge and express views without moving offshore. If products like Kraken's gain traction, the line between crypto-native derivatives and traditional regulated futures may blur.
