Japan will recognize foreign-issued crypto stablecoins as legal electronic payments starting June 1. The ruling party simultaneously proposed slashing crypto gains tax to a flat 20%, matching equities and investment trusts. These changes target the exodus of crypto talent and capital to Singapore and Dubai.
Tax Overhaul Requires Asset Reclassification
For the 20% rate to take effect, Bitcoin and Ethereum must become financial instruments under Japan’s FIEA framework. Current rules tax crypto gains as miscellaneous income at up to 55%. The Japan Cryptoasset Business Association confirmed neighboring hubs tax retail crypto at 0–15%. High taxes have been draining liquidity from Tokyo’s market for years.
Stablecoins Gain Payment Status Legally
Foreign trust-type stablecoins will qualify as Electronic Payment Instruments under the Payment Services Act. The FSA framework takes effect next Friday without requiring new stablecoin issuers to register with regulators. This differs from MiCA in Europe where domestic issuers must comply with capital rules.
ETF Applications Move to Center Stage
SBI Holdings filed Bitcoin and XRP ETF proposals for the Tokyo Stock Exchange. Reclassification under FIEA would finally make these products legal for licensed brokers. Hong Kong already approved spot Bitcoin and Ethereum ETFs, while Singapore maintains zero capital gains tax. Nomura’s Laser Digital and Mitsubishi UFJ Trust are testing tokenized securities under existing frameworks.
Global Rules Race Accelerates
The US Senate Banking Committee advanced the CLARITY Act to clarify SEC and CFTC jurisdiction. Galaxy Digital’s Alex Thorn estimates 65–75% passage odds this year. The EU’s MiCA rules are live and Singapore’s tax advantage remains unchanged. Japan’s moves signal urgency to catch up before the 2026 fiscal year ends.
Japan’s stablecoin change takes effect June 1 while tax legislation is now in parliamentary review. Crypto firms are watching to see if these changes can reverse the talent drain that’s weakened Tokyo’s position.
